Secured lender to charter school
Represented a large U.S. bank in a Chapter 11 filed by a non-profit charter school. Challenged cash collateral usage and valuations, obtained authority to pursue appointment of a state court receiver, and achieved conversion of the case to Chapter 7 while preserving the debtor’s educational mission.

Frequently Asked Questions about Bankruptcy Law Firm in Arizona

What is the difference between bankruptcy reorganization and liquidation options in Arizona?

Chapter 11 allows a business to restructure debt and operations and emerge from the bankruptcy process as an operating business. Liquidation occurs through Chapter 7 or a liquidating plan in Chapter 11, and results in the liquidation of the entity’s assets for the benefit of creditors. The best option depends on liquidity, collateral, and going-concern value.

How quickly can we file and obtain first day relief?

Timelines are set by court procedure. With preparation, many first day motions are heard within the first week after filing. We outline a filing checklist and critical deadlines during the initial consultation.

How do you protect a secured lender’s position?

There are a variety of tools that can be used such as; adequate protection, cash collateral controls, challenges to valuations, and litigating plan treatment and cramdown when appropriate.
