Involuntary Bankruptcy Petitions and Bad Faith as Grounds for Dismissal - by Scott Cohen
I once had three clients trapped in the “gap period” for a full year.1 Others have had it worse.2 In my last involuntary bankruptcy case, the bankruptcy court bifurcated the trial. The first trial was to determine whether the technical requirements of 11 U.S.C.A. § 303 had been satisfied. After multiple trial days, the bankruptcy court found that the § 303 standards had been met.
